2. Acceptance of these terms
By accessing, browsing, registering for, or using Nibella, a user agrees to these Terms & Conditions. If a person does not agree to these terms, they should not use Nibella.
If a user creates an account or uses Nibella on behalf of an organisation, that person confirms that they have authority to do so.
3. The service
Nibella is intended to help users understand recurring bills, subscriptions, price-rise risks, and possible savings opportunities. Features may include:
- account connection and transaction analysis;
- recurring charge detection;
- alerts, reminders, and coaching suggestions;
- educational content and blog materials;
- account, subscription, and preference management.
Nibella may change, improve, suspend, or discontinue features from time to time.
4. Eligibility and accounts
Users must be legally capable of entering into a binding agreement to use Nibella. A user may need to create an account to access some features.
Users must:
- provide accurate and up-to-date information;
- keep login credentials secure and confidential;
- notify the operator promptly of any suspected unauthorised access or misuse;
- be responsible for activity carried out through their account unless the law provides otherwise.
Nibella may suspend or restrict access where there is suspected misuse, fraud, security risk, breach of these terms, or legal necessity.
5. Financial information and connected accounts
Nibella may allow users to connect financial accounts through authorised third-party providers, including open banking or account information service providers.
By connecting an account, the user confirms that:
- they are authorised to connect that account;
- they understand the relevant provider or bank may have separate terms and privacy information;
- Nibella may receive account and transaction data made available through that connection;
- access is intended to be read-only unless otherwise clearly stated.
Nibella is not a bank and is not intended in these terms to hold customer deposits or provide payment account services.
6. No financial, legal, or tax advice
Nibella may provide insights, prompts, summaries, categorizations, savings suggestions, and educational content. Unless expressly stated otherwise, those outputs are provided for general information and product guidance only.
Nibella does not provide regulated financial advice, legal advice, tax advice, or a guarantee that a user will save money, secure better terms, or achieve a particular financial outcome.
Users remain responsible for:
- checking provider terms;
- deciding whether to switch, cancel, renegotiate, or take any financial action;
- confirming the accuracy and suitability of recommendations before acting.
7. Paid plans and billing
Some parts of Nibella may be free, and some may require payment, such as a monthly coaching or alerts subscription.
If a user signs up for a paid plan:
- fees, billing intervals, and key plan details will be shown before purchase;
- the user authorises the relevant payment provider to charge the applicable fees;
- subscriptions may renew automatically unless cancelled in accordance with the plan terms shown at sign-up;
- prices may change in the future, but changes should be communicated before they take effect for future billing periods where required.
Unless stated otherwise, fees are non-refundable except where required by law.
8. Acceptable use
A user must not:
- use Nibella unlawfully or fraudulently;
- interfere with, disrupt, probe, or damage the service or related systems;
- attempt to gain unauthorised access to accounts, data, code, or infrastructure;
- misuse another person's data or financial information;
- copy, scrape, reverse engineer, or exploit the service beyond what applicable law allows;
- upload malicious code, viruses, bots, or harmful automation;
- use Nibella in a way that infringes the rights of others.
9. Intellectual property
All intellectual property rights in Nibella, including its software, branding, content, design, text, graphics, and underlying materials, are owned by or licensed to the operator unless stated otherwise.
Using Nibella does not transfer ownership of any intellectual property rights to the user. Users are granted a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose and in accordance with these terms.
10. User content and feedback
If a user submits content, feedback, suggestions, messages, or support materials through Nibella, the user confirms that they have the right to do so.
To the extent necessary to operate and improve the service, the operator may use that material for support, troubleshooting, service delivery, and product improvement. Personal data contained in such materials will be handled in line with the Privacy Notice.
11. Availability and changes
Nibella aims to provide a reliable service, but uninterrupted availability cannot be guaranteed. Maintenance, technical issues, provider outages, data-source limitations, banking-connection interruptions, or security events may affect service performance.
The operator may update, modify, suspend, or withdraw all or part of Nibella where reasonably necessary.
12. Third-party services and links
Nibella may rely on or link to third-party providers, platforms, APIs, and websites. Those third parties may have their own terms, privacy notices, and technical limitations.
The operator is not responsible for third-party services beyond what applicable law requires.
13. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
Subject to that:
- Nibella is provided on an “as is” and “as available” basis;
- the operator does not guarantee uninterrupted service, complete accuracy, or specific financial outcomes;
- to the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages;
- where the user is using Nibella as a consumer, nothing in these terms is intended to reduce mandatory consumer rights.
If Nibella is supplied to a business user, and unless the law requires otherwise, the operator's total aggregate liability arising out of the service or these terms may be limited to the amount paid by that user to Nibella in the 12 months preceding the event giving rise to the claim.
14. Termination
A user may stop using Nibella at any time. If an account exists, the user may request closure or cancel any paid plan in accordance with the product flow made available at the time.
The operator may suspend or terminate access where reasonably necessary, including for breach of these terms, misuse, security concerns, non-payment, or legal obligations.
Sections that by their nature should continue after termination will remain in effect, including sections on intellectual property, liability, disputes, and payment obligations accrued before termination.
15. Privacy
Use of personal data is governed by the Nibella Privacy Notice, which forms an important part of the overall user relationship.
16. Changes to these terms
These terms may be updated from time to time. The latest version should be published on the Nibella website with the revision date shown at the top.
Where changes materially affect users, reasonable steps should be taken to bring those changes to their attention.
17. Governing law and jurisdiction
These terms are governed by the laws of England and Wales.
If a user is acting as a consumer, that user may also benefit from mandatory protections of the country in which they live, where applicable.
Subject to applicable consumer rights, the courts of England and Wales will have exclusive jurisdiction over disputes relating to these terms or the Nibella service.
